BadDrivr respects the intellectual property rights of others. If you believe content on BadDrivr infringes a copyright you hold, you may submit a DMCA takedown notice under 17 U.S.C. § 512.

This page is informational and describes how we process notices. It is not a legal agreement. Binding terms will be addressed in our final Terms of Service once published.

How to submit a DMCA notice

The fastest way to submit a DMCA notice is through our takedown request form, selecting DMCA copyright infringement as the request type. You may also email takedown@baddrivr.com. A valid notice must include the elements required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works at a single site, a representative list).
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to locate the material — typically the URL of the BadDrivr report or page (e.g. https://baddrivr.com/r/<report-id>).
  4. Information reasonably sufficient to permit us to contact the complaining party (name, address, telephone number, email address).
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notification is accurate, and that the complaining party is authorized to act on behalf of the owner of the right that is allegedly infringed.

Designated agent

BadDrivr operates through its parent entity, Xuberent Technologies Inc. Our designated agent for DMCA notices has been registered with the U.S. Copyright Office under registration reference DMCA-1071815. What happens after you submit

  • We acknowledge receipt of DMCA notices and review them promptly.
  • If the notice is facially valid, we may remove or restrict access to the identified material pending further review.
  • We may notify the user who posted the content and forward the notice to them, as permitted by law.
  • We may, in appropriate cases, terminate the accounts of repeat infringers consistent with applicable law and our policies.

Counter-notices

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include the elements required by 17 U.S.C. § 512(g), including a statement under penalty of perjury and your consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., the district in which BadDrivr may be found). False or abusive notices

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents either (i) that material is infringing, or (ii) that material was removed by mistake, may be liable for damages, including costs and attorneys' fees. We take false or abusive DMCA notices seriously and may refer them to the appropriate authorities.
